California Civil Statute of Limitations In Sex Abuse Cases

Child Victims Act California  If your case is time barred by the statute of limitations you have a THREE YEAR WINDOW beginning January 1, 2020 to revive your claim.  The window closes on December 31, 2022. 

  • Childhood Sexual Abuse SOL:  Age 40 (18 years old + 22 years).  Ca. Civ. Proc. Code § 340.1
  • Limited Discovery Rule:  5 years after a victim discovers an injury caused by the abuse
  • 3 Year Window:  From January 1, 2020 through December 31, 2022

    New York Civil Statute of Limitations In Sex Abuse Cases

    Child Victims Act New York 2019  If your case is time barred by the statute of limitations you have a ONE YEAR WINDOW beginning August 14, 2019 to revive your claim.  The window closes on August 13, 2020.

    • Childhood Sexual Abuse SOL:  Age 55 (18 years old + 37 years)
    • 1 Year Window:  From August 14, 2019 through August 13, 2020 

    New Jersey Civil Statute of Limitations In Sex Abuse Cases

    Child Victims Act New Jersey  If your case is time barred by the statute of limitations you have a TWO YEAR WINDOW beginning December 1, 2019 to revive your claim.  The window closes on November 30, 2021.  

    • Childhood Sexual Abuse SOL:  Age 55 (18 years old + 37 years)
    • 2 Year Window:  From December 1, 2019 through November 30, 2021
    • Includes sexually assaulted as adults

    Pennsylvania Civil Statute of Limitations In Sex Abuse Cases

    Childhood Sexual Abuse SOL:  Age 55 (18 years old + 37 years).  No revival window.

    Hawaii Civil Statute of Limitations In Sex Abuse Cases

    Had several two year revival windows with the last one closing April 24, 2020.  

    • Childhood Sexual Abuse SOL:  Age 26 against perpetrators (18 years old + 8 years); Age 20 against other defendants

    Delaware Statute of Limitations In Sex Abuse Cases

    • No SOL for Suits Based Upon Sexual Abuse of a Minor:  Del. Code Ann. 10, § 8145.  Such suits may be based on any sexual act that constitutes a criminal offense. Id.
    • 2 Year Window : Open from July 1, 2007. Id.

      Florida Statute of Limitations In Sex Abuse Cases

      No civil SOL for claims based on felony child sexual battery offenses against victims under age 16.

      • Childhood Sexual Abuse SOL abused under Age 16:  No statute of limitations
      • Childhood Sexual Abuse SOL for other child sex abuse related claims:  Age 25 (18 years old + 7 years)
